Alfredo Garcia, a paraplegic who has been in a wheelchair since 1996, is a serial plaintiff. The 41-year-old illegal immigrant and convicted felon makes a living suing small businesses in Southern California for allegedly violating the Americans with Disabilities Act and its California equivalent.

I guess this sets a legal precedent that non-citizens are protected by the ADA

Why haven't they deported him already?

Why haven't they deported him already?

Is there some kind of law that puts a hold on deportation if someone has a pending legal case? I have no idea why he's being allowed to remain in the country since he readily admits to being in the U.S. illegally.

Well they could put a stop to the new suits if they slapped him back in jail for the probation violations.  Then let the pending cases wind their way through the system, then deport him when that's done.

this guy gives the disabled a bad name...no wonder we get people who complain that the disabled expect too much...

Welllllll........... I kinda agree with the suits. Businesses have had 20 years to be in compliance with the ADA. If a series of suits made public urges compliance with ADA: I say go for it!

About the guy still being in America..... maybe he was legal when released from prison. The way it works in NE when a felon is being sent to (depending on the crime) or released from prison at their jam date - the person is turned over to INS (or whoever they are now). The same with a parole of an illegal immigrant - they are paroled to INS.

But it isn't increasing compliance.  It is increasing resentment toward the disabled.  If he was interested in compliance rather than making a quick buck, he'd just point out the problem and give them a chance to fix it rather than sue and ask for money to drop the suit (regardless of whether they make the actual improvements).
